MOTIONS OF COUNCIL a) Official Plan Review BE IT RESOLVED that Council directs planning staff to submit the draft of the Official Plan to the Ministry of Municipal Affairs and Housing for their review.
Declaration of Surplus Land/Notice of Public Sale of the former Melrose Heights Subdivision BE IT RESOLVED THAT the following lands are hereby declared surplus to the needs of the City of Timmins: Melrose Heights Subdivision.
Federal governments to review bail policies WHEREAS 2019 the Government of Canada implemented Bill 75, which amended the Criminal Code (Canada) by amending the rules for granting bail and in particular giving the courts more latitude in respect to releasing individuals charged with administration of justice offences, such as failing to appear in court or failing to comply with bail conditions; and WHEREAS the judicial system and correctional system are currently operating under COVID-19 protocols that allow for accused to be issued a Form of Release (Form 9, 10 or 11) when an individual is charged with an offence without having to serve time in custody, which permits the immediate release of the accused due to concerns with reducing the spread of COVID-19 in the correctional system; and WHEREAS, due to the handling of accused in this manner, many of those accused have become repeat or prolific offenders in the City of Timmins as reported by the Chief of Police, causing concern to members of the Timmins Police Services Board, Timmins City Council and the community at large as the attached Timmins Police Services Statistical Occurrence report illustrated that crimes such as Break and Enter and Mischief have increased by as much as 35% during the period of March 24 to September 24, 2002 over the same period in 2019, and WHEREAS implementing appropriate measures during a pandemic to ensure the safety of accused and convicted persons within the correctional system is important and should be addressed by the Ministry of the Solicitor General; and WHEREAS the correctional system in Ontario has not had any publicly reported major outbreaks of COVID-19, which was of concern when the pandemic started in March 2020 and led to the current practice of generally releasing accused persons prior to a hearing; and WHEREAS the incident of repeat offences is increasing in our community and the need for a resolution to these concerns is imperative to ensuring the safety of our citizens; NOW THEREFORE BE IT RESOLVED THAT the Council for The Corporation of the City of Timmins RESPECTFULLY REQUESTS: A. THAT the Solicitor General UNDERTAKE A REVIEW of any policy, directive, guideline or operational change regarding the current practice of releasing accused without holding during the COVID-19 pandemic, with a view to ensuring not only the safety of the correctional system, but also the safety of communities in Ontario who are impacted by repeat offenders who are released pending a hearing; B. THAT the Attorney General for Ontario UNDERTAKE A REVIEW of any policy, directive, guideline or practice by which the judiciary, including justices of the peace, release accused without holding pending a hearing, despite the accused being charged with multiple offences or repeat offences, with a view to ensuring the safety of communities in Ontario who are impacted by repeat offenders; and C. THAT the Minister of Justice and Attorney General of Canada UNDERTAKE A REVIEW of the amendments to the Criminal Code (Canada), among other Acts, implemented by Bill 75, which modernized and streamlined the bail regime, to determine whether those amendments do in fact ensure public safety and confidence in the criminal justice system, as promised, or whether additional amendments may be required in order to create a more robust process for those persons accused of multiple or repeat offences; and D. THAT a copy of this resolution be forwarded to the Solicitor General for Ontario, the Honourable Sylvia Jones, the Attorney General for Ontario, the Honourable Doug Downey; the Minister of Justice and Attorney General for Canada, the Honourable David Lametti; the Member of the Legislative Assembly for Timmins , Mr. Gilles Bisson, as well as the Association of Municipalities of Ontario with an invitation for other municipalities across Ontario to join the City of Timmins in this appeal to the Solicitor General and the Attorney General for safer communities during the COVID-19 pandemic.

m) Waive Lease Payments to Organizations Leasing Space in City-Owned Facilities During Mandatory Closures WHEREAS several organizations, (Lessees) have lease agreements with the City of Timmins (Lessor) allowing them to conduct their activities in City of Timmins owned facilities. AND WHEREAS during COVID-19 some of these organizations were effectively prevented from totally accessing their leased facilities or were later allowed access with restrictive limitations mandated by public health authorities. AND WHEREAS after eventually being allowed to access city-owed facilities, these mandated policies by public health authorities such as social distancing, maximum number allowed and sanitizing procedures, made it impossible for some groups to realistically operate the leased areas under those restrictions. AND WHEREAS this situation of not being able to realistically comply resulted in these organizations furthering suffering the loss of their ability to raise revenue to support their entities to various degrees by up to as much as 100%. AND WHEREAS these restrictions are still in place and there is no definite conclusion to this loss of revenue generating capabilities with respect to the current COVID-19 pandemic and mandated regulations. AND WHEREAS several of these organizations are deemed to not qualify under the previous Canada Emergency Commercial Rent Assistance (CECRA) and will not likely qualify under this week's announced Canada Emergency Rent Subsidy (CERB). BE IT RESOLVED THAT the City of Timmins waive lease payment due from these organizations, on a pro-rated basis during the entire time that they were either 100% completely barred, or partially, affected by public health restrictions, from fully using leased City of Timmins facilities to conduct their activities. (Example ratio 100% loos of income = 100% waiver of City rent payments and so on a declining scale). BE IT FURTHER RESOLVED THAT all waivers will be based on application and financial information being provided to the City of Timmins for audit indicating the percentage loss of income incurred during the period March 2020 until such time as a return to normal operating activities is possible. BE IT FURTHER RESOLVED THAT any single entity be restricted under this program to maximum waiver amounts of lease payments under total full closure or partial restrictions not to exceed a maximum of $25,000. BE IT FURTHER RESOLVED THAT this resolution supersedes any other program approved by the City of Timmins offering the waiving of lease payments for organizations that have suffered revenue losses during a full lockdown or compiling with restrictions mandated by public health authorities. 10.
